He has only done six open houses for my house and it seems like he wants to do them only occassionally now and I want him to keep doing them because I don’t feel he is doing enough to sell my home. Realtor.com is still the best site out there, if you want a national search. And NO, most of the homes listed there are NOT under contract. They are removed from realtor.com when they go under contract.

If you’re looking in 55+ communities, there are some good bargains to be had in SE Florida like Palm Beach County. You need to find a dependable realtor though. If you’re financing, you might want to start with a good mortgage broker and go from there.

Misleading Home seller/Realtor?

Last Night I was bored..logged onto Realtor.com and just for fun was looking at homes in our old neighborhood. I spotted our previous home, now on the market again. I had heard that the buyers have “trashed it” within months, which was sad to hear, nonetheless…the photos that were posted on Realtor.com was photos of when WE lived in the home/our furnishings etc,from over 2 yrs ago instead of the current homeowners. Is that permitted? I also feel that it’s extremely misleading the the potential buyer, considering the home looks nothing like that now…just curious?

If the only difference was in the furnishings, then it is legal.

If the photos show a significant difference in the condition of the house, then yes there is a problem. Maybe not legally, but certainly morally.

People viewing the house will see the difference and know they are dealing with a lazy or untrustworthy realtor who misrepresents the property.

Realtor steering us to certain neighborhoods?

First time buyers here, got a realtor through our lender (whom we trust) and this realtor set us up with an account where we can see property he finds through his search. However, his search has multiple listings in towns we do NOT want to live in and does not include the few listings we have found in our own town. I sent him links to these wanted properties via realtor.com and he responded that all of those were contingent but that realtor.com doesn’t update regularly so we should just stick to his search engine. All these listings said ‘active’ when I looked at them. His search engine doesn’t have a single property in the areas we want! Is he doing this on purpose to steer us towards these less desirable areas – which I’m sure he has a hard time selling? We have no contract with him. Shouldn’t a Realtor look into any property we find, no matter where we find it?

Public sites, like Realtor.com are known to be less accurate than the direct link your agent has with the MLS. Your agent has much more up to date information. In most cases, he his search gets information is less than an hour after it’s been updated. Public sites do not pay the big money to have updates this quickly.

That said, he could have filtered down your query too far and is not getting all the results. It’s crazy to think that he would risk losing a commission by purposely excluding something you say you want to look at.

Bottom line for me would be that you now have a bad taste in your mouth with him. If you don’t know him, don’t have a contract with him, and you don’t feel like he’s answering your questions about this very well then move on to someone else. Agents are a dime a dozen. Find one that will spend the time to explain things to you better.

It is like a timeshare. You would not be able to live there. That one says you could use it 21 days per year. Timeshares are a horrible deal. Even if you got a timeshare for free, the membership fees and dues make it better to just rent a hotel or whatever lodging for your vacations.

Yes, it is normal for a seller to actively seek secondary offers, in the event that you fail to close on YOUR offer. Your offer (if it is the first accepted offer) is primary, and the others are secondary. One of those secondary offers may be moved intso primary status if your offer fails to close as expected.

Homes are not removed from www.realtor.com until the listing agent changes the status of the property in his local MLS. That is where www.realtor.com draws its information. A listing on Zillow won’t change until the person who placed the listing directs that it be changed.

The seller’s bank cares about neither your credit score nor your downpayment, as long as you are able to close the purchase as agreed.

Whenever you buy a house, a title company does a search on a title, and the property cannot be transferred until all “clouds” on a title are resolved, and you have a clear title. There are some exceptions to this (as everything in life) however the title company is required to inform you of this and you can choose not to buy the property if this is the case.

Of coure, title companies are not perfect either, and I would definintely buy title insurance if you are purchasing a house. That way if something comes up later, the title company is responsible up to the amount of your insurance to “fix” the title. If you are getting a mortgage on the house, the lender will require that you purchase title insurance for them, but make sure you pay the extra and have a policy that protects yourself as well, it’s not that much more, and is in effect for the entire period that you own the home, and definitley worthwhile.

An example of a title company making mistakes…..

My sister purchased a home (before I started in Real Estate) that when she went to sell, the title company found a lien that the title company when she purchased did not find. My sister did not have title insurance. It took several days off work, alot of research, and some good luck, but she was able to have the lein released without paying it. She found the person who had the 2nd mortage that was not released, and luckily they had paid the mortgage, kept proof of it, and were willing to share it with her, otherwise she would have had to pay the $20,000 to sell the house.

As someone buying a home, how do you prefer to look for houses for sale?

Do you look on websites like realtor.com or do you rely on an agent to show you houses based on your requirements or do you drive around looking at for sale signs in neighborhoods you’d like to live in? Or do you attend Open Houses only. I’m just curious.

The Expert answers:

I have done this several times. First of all I select an area of the city that I want to reside in. I check the crime rate by calling the local police. Once that has been completed and I have decided on an area to reside in, I check and see if I can afford this area.

If I can afford the area I then find out if there are or were built the number of bedrooms I require.

Since I might find a FSBO I then drive through this area to see if there are any house I might be interested in just looking from the outside.

I am so looking how racial diversified the area is. I am not interested in an area that has a collection of all one race. How the area is kept, are the lawns mowed and in good condition. How many children are in the nieigborhood.

Now I check and see if there are possible foreclosures in the area. If there are possible foreclosures in the area, I find them, make contact and see if there is a possible deal that can be struck. Like assuming an existing mortgage, with a low down payment or the seller taking back a mortgage note.

I also contact any FSBO to see if I can make any deal with them. I look for the same as a foreclosure to see if I can assume, with a low down payment or a seller carry second.

Before closing the transaction I normally select a Fri or Sat nite to sit in front or near the house to see if there is community noise or other undesirable things happening that would kep me from the purchase of the home.

Now most buyers don’t take the time to do this, but that is exactly why they wind up with places they later want to get rid of. The don’t check for possible deals with the foreclosures and FSBO.

They simply follow a real estate agent around that will not tell them the truth about a neighborhooh because the truth will cause the deal to fall through.

I did this once, the real estate agent told me that I was buying in a nice and good nieghborhood. Well I sat in the neighborhood on a Sat nite and they had a shoot out across the street from where I wanted to buy. When I presented the real estate agent with this new found information, all I got was it was safe before.

After checking the crime report from the city I found that there were 3 shooting in the last 2-3 months. Several drug related arrest within a 1-2 block area of the house.

I learned that most real estate agents don’t even work the area that they sell houses in and therefore are ignorant of the going on in the area in which you are buying..

So you have to take all the precautions necessary,because the real estate agent will tell you I don’t have to disclose the information and will point it out to you in some contract you might have to sign.

I very seldom look at the internet seeking to purchase a home because they might not simplify the area I am looking in to purchase.

Should I find a new realtor?

We are trying to sell our house, has been on the market since the middle of July. It is listed on the MLS, and realtors personal website with photos that he took. The description isn’t the best, suchs as “House shows well.” It was listed on realtor.com with no picture and it took several phone calls, emails and US finally contacting realtor.com for him to finally put the picture of our house on realtor.com. We had to request a newspaper ad (which he hasn’t done yet), open house, literature box to put the color ads in that we made and paid for. He takes his time and is not aggressively selling our home. He tells us it’s not a good time to sell, yet he just now listed a house that he owns 2 streets down. He only emails and sends paperwork in the mail. Not personable at all, all for a 7% commision. We have had nothing but great feedback of the house, it’s the location across from a apartment complex that is negative. We really would like to move out of state by winter
Our contract says nothing about firing, leaving etc. I’m not going to pay someone who is NOT doing their job. We have discussed our frustrations with him, and he keeps saying “well the market is soft…” All I’m asking for is that he try to sell my house. He told us the house will sell itself. He pretty much has done the bare minimum.

But your best bet is to built a network of people you want to work with in your own area and one of these people should be an agent that is willing to go to bat for you,

they can likely search and set up automated searcehs for you that will send you properties by email, keep in mind that you will have to set some parameter on what it is that you are looking for, and asking for all the good deals, is not possible..

In my little town of Victoria BC canada, we get well over 100 new and or updated listings each and everyday, just imagine the number of listings that are entered all over the continent, ther is no way that you can determine what is a good deal with out spending time on each property, individually, so it is up to you to determine what exactly it is that fits your specific criteria, and locations, then it may be possible to create some sort of raw search that will send you a lot of duds, and very few golden nuggets, but that is part of the process.

But with patience, and most importantly a great network of likeminded people you can find the nuggets and do your thing

As a buyer you want to see all that is out there, As a seller you want it out there also yet ehy seem to be holding back on this information. Also they do not list new homes, forecloses , short sale and the list goes on.

You always hear of supply and demand well this is how they have shorted the supply and Guss what is drove up the prices and now the bubble is breaking.

Your question is difficult to answer as no one will be able to see your actual credit report. There are some negative things on your credit report that the lender would simply require a letter of explanation as to what happen, why it happen and the results. Then there are some negative things on your credit report that would require third party proof that the item no longer exist.

Repeated non payment of a debt over a long period of time would cause reason for an underwriter to take a longer look at your credit score and might require a letter of explanation.

Some individuals that have bad credit might still qualify for a mortgage loan, some might even with a score around 580.

FHA and VA loans are less stringent than the normal conventional mortgage loans. Therefore what might be a reason for disapproval with a conventional lender a letter of explanation might be good enough for a FHA mortgage loan.

Negative medical items on your credit report might not be as big of a problem as might be expected.

One way to find out if about your credit report it to get your free credit report on line. This credit report will not have your credit scores, however, it will list any negative items on your credit report.

The best way to find out if you are qualified for a mortgage loan is to contact a local mortgage lender, complete a mortgage loan application. In this process the mortgage broker will get your credit report with your credit scores. If you are qualified for a mortgage loan you may continue the process. If you are not qualified the mortgage loan officer will let you know what you need to do to become qualified credit or income wise.

You will be best served by locating a real estate buyer’s agent to provide you with houses that fit your criteria. That is your price range, sub division, type of house, schools and so on. The buyer’s agent is usually paid by the seller even if you have a buyer broker agreement with your agent.

So often the web sites do not give you up to date information. You don’t know if the house has an offer on it, if it is a short sale, if the price has been reduced or even if it is still on the market! When I was active in real estate I would get inquiries on houses showing active on the internet that had sold six months ago!

A buyer’s agent does not have an agreement with the seller as does the listing agent and the buyer’s agent will be able to show you days on the market, sales within the past three months, a good idea of how long it takes to close a short sale (probably never!), recommend a house inspector and walk you through all the many steps to closing.

A good agent is worth his or her weight in gold and will save you time and frustration.

I’m selling my house and have met with two realtors that were on the listing given to me by the relocation company. However, I’m unsure which realtor I should choose.

LOCAL REALTOR
Good-
- Great salesperson with a wonderful, friendly personality
- Brought a spiral-bound marketing plan to the review meeting
- Took photos with a wide lens to get the full room in one shot
- Posts listing on Realtor.com with a virtual tour
Bad-
- Small, local company
- Their unpolished website has very few visitors
- Agent doesn’t check email reguarly

NATIONWIDE REALTOR
Good-
- Nationwide company with a beautiful website (ColdwellBanker.com)
- If someone inquires, their number is automatically text messaged to the agent
- Will put signs AND flyers in yard
Bad-
- Agent is a very nervous salesperson who stumbles over her words
- Brought a folder with loose papers to the review meeting- seems disorganized
- Does not list on Realtor.com
My only concern with the local agent is that the house will not be marketed around the Internet. I live in a high industry city that will have a lot of transfers this summer. I want to have the house listed as much as possible as people from all over will be reviewing houses.

Also, the nationwide realtor commented that, “Well, if an engineer comes into town, they’re not going to buy this house.” I AM an engineer and make enough money for a bigger, nicer house. I just didn’t think I needed a huge house (and I really don’t). Plus, it’s a great, quiet neighborhood near the lake.

So, my concern is that she will only market to those she thinks can afford the house.
I can only go with the given realtors.
I don’t need ads for your or your friend’s company… or any realtor recommendations. I was given these two realtors by the relocation company. In order for the relocation to succeed through my company, I must use one of these realtors.

If your local is advertising on Realtor.com that is good, if the nation wide doesn’t it means they aren’t Realtors, they are just real state agents. I wouldn’t recommend any one not on Realtor.com. I don’t work for Realtor.com but is one of the most popular sights for buyers to at least start with.

Depends on your area. If you plan on selling your house to locally person than a local Realtor could be fine. If you are in an area that your buyer may be coming form out side than I would recommend a national/international company that is all over the web including Realtor.com. BUT MAKE SURE IT HAS A LOCAL OFFICE. Big companies such as but not limited to C21, Re max, Prudential will come up often in searches have brand recognition and people new to the area my fell more comfortable dealing with a company they have heard of instead of somebody they they have never heard of.

Don’t fell limited to your relocation company, they are offer you this service to make themselves money. The little money they offer you back may not be worth it. The only reason you have two choices is because they may be the only two agencies that will pay the relocation company the $$ they are looking for. That doesn’t mean the companies they provide are better or worse than anybody else.

Exposure/marketing is the name of the game.

Do not go to a discount brokerage of any kind to get information. Look at it this way, the sellers are represented by a professional negotiator who specializes in real estate. You want a professional negotiator who specializes in real estate working for you. The best way to find a home is to contact a Buyer Specialist at a reputable real estate brokerage.

I do not know what area of So. Cal you are talking about, but as a Realtor myself for 16 years, (yes I am a professional negotiator) I would contact a specialist in the area I was moving to.

By the way…Realtor.com is pathetic. There is one heck of a lot of outdated listings. It is not as automated as they tell us Realtors it is. Bag it. It is a waste of time.

It may be but more amd more sites are making it difficult to extract data from their web sites to prevent copyright infringement. You need to consider first whether your intended activity would violate such rights of realtor.com for two reasons.

The first and it should be the most important is the question – is what you are doing legal and ethical.

The second is the question of consequences. There is a small chance that you could be discovered and taken to court. There is the chance that the time you spend trying to download the data will just be wasted. There is a chance that after you have spent hours developing a working solution, the web site will be changed in a way that completely stops it from working.

Be aware that the last chance exists even where what you want to do is completely ethical and legal.

If you decide that what you want to do is ethical, legal and worth the risk then you can

Start macro recording to capture what you are doing.

Select Data > Import External Data > New Web Query

Navigate in the browser that pops up to the information you want to capture and see if you can select it for import. If you can, then complete the import and look at what shows up in your Excel worksheet. If that is usable, then continue developing and testing. If it is not usable, you can retry until you decide that it is very unlikely that you will be able to get what you want.

Another option you should consider would be to contact realtor.com about how they could make the data you need avaialbe at a reasonable cost.

OK. Im trying to purchase a home, i’m scared and VERY CONFUSED!! i have been pre-approved for a loan and have looked at several houses. I have placed offers on three homes but nothing has happened. This is the deal: I have an realtor (who is suppossedly representing me) and I feel that she’s not doing her job, I feel that she wants to sell the houses she likes not the houses im interested in. Now my question is I want to change agent and cancel her out…however, I have given her the 1000 deposit which she said was going into “escrow” …if i cancel and decide to look with someone else will i lose that money??? Please help with any advise…i really dont want to be screwed over….I feel sooooo ignorant…and really frustrated because i’ve read soo much information on first time home buying tips etc etc …and it’s just not clear to me…Thanks.

Did you sign a document stating that you would employ this real estate agent for a certain length of time.

If you did the agent might demand that the time expire on the contact before she quits.

If you just want to get out of the contract simply write letter to her broker and send her a copy indicating that you are not pleased with the real estate agent and no longer desire her services nor the services of the real estate broker service, and to please return my $1000.00 deposit.

The $1000.00 was for a deposit on a propeprty and not for her personal use, so she should return this without fail.

Make sure you put this in writing and not verbally. You might need proof that you displeasure was of a certain date.

She still might be in a position to collect a commission from you if you purchase a house she has shown you or introduced you to an agent that might sell you a house down the road.

So you want to make sure that you use none of her properties she introduced you to nor any agent she introduced you too.

You may look for a property on your own, why do you want a real estate agent to show you houses that are available on the Internet and other places.

Find an area that you want to reside, check the cost of houses in this area and see if you can afford this neighborhood, if not then you will have to lower your expectations.

Attend open houses in the neighborhood you want to reside in after you have decided that you can afford to reside there. Your pre-approval should tell you how much house you can afford.

When making an offer don’t feel bad about making an offer less than the asking price.

If you still want to use a real estate agent check with your mortgage broker that pre-approved you and see if he can give you a referral for a real estate agent. That is unless he recommended your current agent.

Check with other professionals you know to include family and friends to see if they can recommend a good agent they have used in the past.

Friends are not good people to use, even if they are in the real estate field.

Hey, well my parents have been looking into buying a house in cash for about 6 months now, in fact my parents have in the past, submitted 3 different applications to buy a house in cash fully but they always end up being “out-bought” by some other person who takes out a loan….how is this possible? My parents currently have 3 new pending applications for great homes all 3 of those homes cost around $90K and my parents are offering the banks around $6- 10K more than the house actually costs is this a good way of convincing banks to let us buy the house? Because i mean we will pay fully in cash and we even offer more money than the house is worth and yet the banks approve people who take out loans and don’t offer more than us, why is this? are banks just stupid or is it a matter of luck? Any tips on how to seduce banks into approving us (aside from offering even more money in cash)?. Thanks in advanced!

That’s very stranege, usually cash offers get top priority.

However, maybe those properties were priced hot and got offers even 10K higher than asking.

My client wants to withdraw funds from his 401k to buy a home. Any tips on getting Prudential to release funds?

We have an accepted offer on a bank owned home, and banks typically are slow to release signatures on documents if at all. To be conscious of the deadlines, we need the funds to pay for inspections and so forth. Prudential said they wouldn’t release funds unless we gave them all the documents signed by the seller. Banks typically give verbal responses and agreements, and I might have a challenge getting our documents returned before the deadlines pass.

The Expert answers:

Ah yes, dealing with funds. I’ve used my self-directed IRA in a similar situation. Ask Prudential if your client can pay for it upfront then get reimbursed at closing. It’s for the same purpose you are just keeping within the deadlines to streamline the process.

I guess the risk would be that your buyers may fork out the $$ and then deal doesn’t go through and that money doesn’t get reimbursed from the 401K. Good luck!

Ok I’m a first time home buyer and I’m also in the process of buying a brand new home from KB Homes in Lancaster,CA. The total cost for the home is $137,000 and I have been pre-aproved but I wasn’t told for how much the loanwould be. I was told that my total downpayment would be between $10,000 to $12,000 I have given my information and also just recently gave $3000 to start the process of the paperwork and etc I was also told that if I decide to stop the paper work or just cancel everything I would loose my $3000, but heres what I found “fishy” from them I wasn’t told about programs that they are for 1st time home buyers, loan options,.Now heres were I need help from you guys or tips, suggestions or precautions that I should know or do before signing the closing papers.

1. Is there any possible way that I can bring a RE agent to help me with the closing papers and tell me whats right or not right for me?

Mayo will make your hair very shiny……just get a jar and put it all over your hair and then wrap a plastic bag around your head and let it set for about ten minutes or fifteen……you’ll have to wash it 2 or 3 times with dish soap (depending on how long and thick your hair is)…..oh, and I must warn you, you won’t be able to eat mayo for a while because its not the best smelling on your head. A few more tips for healthy hair is to use a soft bristle brush when your hair is wet to reduce in breakage, when you are towel drying your hair don’t be a maniac..just gently pat it. If it is possible you should use olive oil shampoo, its organic and very good for your hair though it costs about $4. Be sure to get it trimmed every month or 2 to keep the dead ends away because dead ends stop hair growth. When you are washing your hair in the shower massage your head for a good 2 minutes, this stimulates hair growth. Try not to wear the pony tail holders that have the metal thing on them because that also breaks your hair and if you use heat stylers (curling iron, blow dryer, straightener…) spray your hair with a heat protectant that you can get pretty cheap at Wal-Mart to keep your hair from getting damaged. real estate contracts (breach)?

I bought a home from a builder where the builder and developer promised dog parks. However they were not honest with the people in the homes near the park sites. They didn’t tell these homeowners that there would be dog parks near their homes. So those homeowners banded together and raised hell and the developer backed down.
I am disabled and have a service dog. My disability causes me to not be able to drive at times which I why I specificly asked if there would be dog parks in the community and they told me yes. Now they’re not building them. My service dog is a 75lb labrador who needs exercise and I can’t always drive her to a park. While they should’ve been honest with those few homeowners near the park site, doesn’t this constitute breach of contract with me and the others they promised the dog parks to. While we don’t have the promise in writing, it’s in advertisements and they clearly offered it or those homeowners would’ve had fought them and made them back ddown.

Unfortunately for you , no.

Unless the contract of sale expressly represented there would be a dogpark AND it states that the representation shall survive closing.

Under the “merger doctrine”, all prior representations made in a real estate deal (even in the contract) are deemed to be merged into the deed. In other words, unless a provision is stated to survive the closing, the law assumes that if you took the deed at the closing, the seller has satisifed all its conditions and promises or you have waived them.

As for advertising, I would take a look at them and see what they say very carefully. If they represent there will be dog parks, I would call my state attorney general and ask them if this is some type of consumer fraud or false advertising. If there is enough interest, they may start an investigation that may get you some compensation for your troubles. If they merely state it is their intention to create a dog park, then you are probably out of luck because they didn’t anticipate so much opposition from the neighbors, and it was probably a planning board decision on their site plan after public outcry to request they not be dog parks, and the developer probably had little or no control over that.

Investment Ideas / Real Estate Ideas?

I am thinking about investing into real estate later in life so I have additional income. I have always been into music and from my experience, the demand for warehouses (band rehearsal space) is very high in my area. I was wondering if it would be a good idea to purchase a warehouse, say 50K with a 30 year term, and renting it out to bands. Most warehouses go for about 300 a month per band here, so assuming I have 2-3 bands renting it out, I’d make at least a small profit every month depending on my P&I amount. Of course I wouldn’t purchase a warehouse unless A. I could afford the rent without renting it out to bands, and B. I either break even or make a small profit from the tenants. Another idea is purchasing a really cheap condominium / house and renting it out as well. I’m still very young, so I don’t have much knowledge when it comes to investing or purchasing property, so any information / ideas would be greatly appreciated.

There are a lot of commercial buildings (warehouses) in foreclosure lately and you may be able to get a good deal on such a building. It could be a lucrative business to rent out the music space, if you got the building for a good deal.
